Buyer Protection Money Back Guarantee / Basic Buyer Protection

These Terms & Conditions apply to the “Buyer Protection Money Back Guarantee” or “Basic Buyer Protection” in MartDo (the “Buyer Protection”).

Promoter

The contracting party determined in accordance with the section “1.1 Contracting Party” of the MartDo Transaction Services Agreement (“MartDo” or the “Promoter”).

Eligible Member

You must be a registered member of MartDo with a valid account and have successfully made and completed a purchase of goods and/or services on MartDo.

Buyer Protection Period

The number of days (appearing/confirmed on the product listing page at the time when the Eligible Member completed the purchase from the seller on MartDo) which the seller guarantees the Eligible Member that it would receive the goods and/or services ordered from the seller, start counting from the day the Eligible Member completes such purchase on MartDo.

Rules

• If the Eligible Member does not receive the goods and/or services within Buyer Protection Period or receives goods and/or services that are sub-standard, the Eligible Member may initiate dispute procedures under “Disputes and Reports” to report this incident to MartDo.

• During the Dispute Procedures, MartDo will investigate considering factors such as:

  • Whether goods/services are damaged, defective, or substantially different from what was described.

  • Whether non-arrival is due to factors beyond the Eligible Member’s control.

  • Whether non-arrival is due to error/miscommunication by the Eligible Member (e.g., incorrect shipping address).

  • Whether goods/services are returned due to customs clearance issues.

• MartDo may request relevant information, documentation, or evidence to support the claim.

• After investigation, MartDo will make a final determination. If in favor of the Eligible Member, a refund will be issued within 15 days after completion of the Dispute Procedures, generally credited to the same payment method used.

General Rules

• By participating, you agree to be bound by these Official Rules.

• Fraud or abuse will result in forfeiture of eligibility.

• MartDo is not responsible for late, lost, delayed, incomplete, or misdirected entries or correspondence.

• Eligibility is determined solely by MartDo’s records.

• MartDo reserves the right to amend these rules without prior notice. Decisions are final and binding.

• MartDo reserves the right to cancel or revoke participation rights at its discretion.

Force Majeure

MartDo shall not be held liable for Buyer Protection due to causes beyond its reasonable control, including but not limited to natural disasters, strikes, riots, civil disturbances, shortages, fires, floods, war, governmental actions, epidemics, pandemics, or disruptions in transportation or operations.

Conflict of Terms and Conditions

• In case of discrepancies between English and other language versions, the English version shall prevail.

• If these Official Rules conflict with other information displayed on MartDo, these Rules shall prevail. The MartDo Transaction Services Agreement shall complement these Rules.

Disclaimer

To the maximum extent permitted by law, MartDo will not be liable for any direct, indirect, special, incidental, exemplary, punitive, or consequential damages arising out of participation in Buyer Protection.

Disputes

MartDo and its affiliates shall not be responsible or liable for disputes or claims arising from participation in Buyer Protection.

Governing Law and Dispute Resolution

This Buyer Protection is governed by the laws of Hong Kong. Legal actions or proceedings must be resolved by arbitration with the Hong Kong International Arbitration Centre, as stipulated in the MartDo Transaction Services Agreement.
